New California Statute of Limitations on Sexual Assault

More Time to Pursue Action

New laws give survivors of Scouting sexual abuse in California more time to file lawsuits against their abusers. On October 13, California Governor Gavin Newsom signed Assembly Bill 218 into law. This bill gives sexual abuse victims more time to pursue justice and compensation for their abuse and pain & suffering. 

California survivors now have until the age of 40 or five years after abuse discovery to file a lawsuit against alleged abuser(s).

3-Year "Lookback Window"

AB218 completely removes the statute of limitations for sexual abuse for three years. 

Within this three-year time frame, California sexual abuse survivors have the opportunity to sue abusers, even if past statute of limitations made them ineligible to sue. The lookback window also applies to survivors whose cases expired under old statute of limitations. This gives thousands of Scouting sexual abuse victims in California second chance to file lawsuits for the crimes inflicted on them by Scouting leaders in the past. 
The 3-year California lookback window begins January 1, 2020 and ends January 1, 2023.
